Please read the terms and conditions below carefully before placing an order from this website. By ordering any goods or services from Fabyto via the web or through our mobile applications, you agree to be bound by these terms and conditions:

These Terms apply to all visitors, users and others who wish to access or use the Service.

If you do not agree to any part of the terms, you do not have permission to access the Service.

In addition, by using certain services, you will be subject to additional terms applicable to such services that may be posted on the Service from time to time without limitation.

 

Definitions
'Agreement’ is a reference to these terms and conditions, the privacy policy, any order form and payment instructions provided to you;


‘Privacy policy’ means the policy displayed on our website which details how we collect and store your personal data;


‘You’, ‘Your’ and ‘Yours’ are references to you, the person accessing this website and ordering any of our products from the website or any other channels provided by Fabyto;


‘We’, ‘Us’, ‘Our’ and ‘Fabyto’ are references to the company;


‘Goods’ is a reference to any goods which we may offer for sale from our website from time to time;


‘Service’ or ‘Services’ is a reference to any service which we may supply and which you may request for from us, Fabyto;


‘Food delivery’ is a reference to perishable goods and any form of delivery service.


‘Website’ and ‘App’ are references to our website http://www.fabyto.com or our mobile application through which we offer our goods and services.

 

Fabyto offers a marketplace for all.

It is not a seller itself and does not prepare, pack or sell food. Our Services include allowing users to connect with each other and related services, but we are not a party to any purchase or sale transaction.

To encourage retention of use of the Service, Fabyto can also help facilitate the resolution of disputes between Customers and Sellers, but Fabyto has no control over and does not guarantee 
(a) the existence, quality, safety, authenticity, or legality of Meals offered or sold on the Service; 
(b) the truth or accuracy of a Seller's content or listings on the Service; 
(c) the ability of a Seller to sell Meals through the Service and deliver Meals within required delivery windows; 
(d) the ability of Customers to pay for Meals purchased through the Service; or 
(e) that a Customer or Seller will actually complete a transaction, effectuate trouble-free delivery and shipping, or return a Meal through the Service.


​Sellers are independent business owners and independent contractors and not employees, partners, representatives, agents, joint venturers, independent contractors or franchisees of Fabyto. Fabyto does not cook, package or deliver food and does not employ people to cook, package or deliver food.


Accounts
When you create an account with us, you guarantee that you are over 18 and that the information you provide is accurate, complete, and up-to-date. Inaccurate, incomplete or outdated information may result in the immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password, including, but not limited to, restricting access to your computer and/or account. You agree to accept responsibility for each and every activity or action that occurs under your account and/or password, whether your password is from our Service or from a third party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization.You may not use any name that is offensive, vulgar, or obscene as a username.

Fabyto uses third party payment handlers to process your payment. The third-party payment gateway provides services for the issuance, use and management of e-money. These services are offered in the App as a means of payment for Fabyto.


By signing up to Fabyto (both as a user and Home Seller), you agree to be bound by the Terms and Conditions of the third-party payment gateway service provider.

 


General

18 is the minimum age to use Fabyto services


You can make use of our services at your sole risk


Fabiyo does not allow anything (Like reselling or so) other than your own use


Any order can be rejected or canceled due to some issues related to unavailability, deliverability and acceptance.


We reserve the right to alter products information at our will


Total price for food available on the platform will be including tax


The price of each product is shown in INR against each product listed


We will not be liable for late delivery for any order that you place


Even if you find the same dishes, the taste may vary as it is prepared by different Chefs. If something arises from this, we are not responsible for refunds.


In case the quality, quantity of items and weight vary, we are not responsible or eligible for refunds.


We can alter or vary the terms and conditions at any time without notifying you.

We may cancel an order if the product is not available for reasons beyond our control. We will notify you if this is the case and we will refund any payments you have made.

Please note that we may not be able to deliver to some locations. If this is the case, we will inform you using the contact details you provide when placing your order and we will arrange the cancellation of the order or delivery to an alternative address.

In the unlikely event of a failed delivery for reasons beyond the customer's control, Fabyto will refund the full amount to the customer within 15 to 20 business days through the same source from which the payment was made.

In the unlikely event that we deliver a wrong item, you have the right to refuse delivery of the wrong item and the full amount of the missing item will be refunded to you.

If we can only make a partial delivery (some items may not be available), we will inform you or propose a replacement for the missing items. You have the right to reject a partial order before delivery and get a refund.

Failure to pay on time will result in the cancellation of your order.

It should be noted by the client that once registered he will start receiving all kinds of promotional SMS, emails and notifications to keep him updated with our offers and other forms of information.


You agree that you are solely responsible for your interactions with any other user in connection with the Service and Fabyto will have no responsibility or liability in this regard.

Fabyto reserves the right, but has no obligation, to become involved in any way in disputes between you and any other user of the Service.


Chef terms and conditions;


Chefs must take all security measures from preparation to delivery of the products.

Chefs are responsible for ensuring hygiene and care in everything they prepare and deliver.


It is the chef's responsibility to comply with all covid protocols.


Fabyto will not allow the use of harmful colours and preservatives in cooking and we will not be responsible for any harm to health or illness caused by this.


Chefs should use only fresh oil and ingredients and veg to prepare the food sold via the Fabyto 


Using old or damaged food is not allowed and we are not responsible for any issue of that sort


Fabyto allows only halal food to list and sell on the platform


Fabyto does not allow to sell burned over salty or heated food


Chefs are responsible to ensure the readiness of food on time.


Chefs must be open to accept cooking instructions from the customer end. 


Chefs must accept returns if the customer is not satisfied on account of damaged packing, cold food etc.


In case of returning the food, delivery charges will be incurred. 


Chefs are to follow the instructions given by the Fabyto team.


Chefs are required to maintain needed licenses and certificates asper the policy of Fabyto.


Chefs have to collect necessary permits and be aware of the Rules & Regulations properly.

Chefs are responsible for informing Fabyto if they are unable to take orders due to prior commitments, sickness, holidays, etc. 


The chef must use real photographs of his/ her dishes.


The Chefs are solely responsible for the preparation and timely delivery of food (as per terms specified on their profile) as well as for maintaining quality and hygiene. Fabyto will not be responsible or liable for the quantity or quality of meals delivered.

Fabyto will not be responsible for any health damages or sickness caused due to the food delivered by the Chefs.

Fabyto will monitor Chefs closely, using Customer feedback provided in any form to Fabyto and will remove and block Chefs if they are unable to comply with our standards and/or tarnish our reputation.

Any information provided by the Chef including photos, menu items, profile descriptions, etc. can be used by Fabyto for various purposes, including business development, promotions, etc.

The Chefs can not, under any circumstances, place orders on their own profiles.


All Chefs must complete the KYC


The chef must have a clean and sanitized working environment in order to ensure the food is safe to consume, without the food causing any health problems.


All the ingredients used to prepare the food items have to be of good quality and it is the responsibility of the chefs to avoid expired, stale, rancid, rot, spoiled ingredients.


And also they must ensure an appropriate number of items, the quantity and weight of the food that they sell via Fabyto

Chefs must follow Fabyto brand packaging and use the materials provided to them and never use any of our materials and packaging for their personal or third party use.

 


Limitation Of Liability 

In no event shall Fabyto, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

 


We will make appropriate changes from time to time and we will notify you via email.
